In this regard, we inform you that, during the registration procedure for your orders, you will be redirected to the websites of our collaborators in order to collect the necessary payment data.

Order placement is done by following the following steps:

9. PAYMENTS AND LIMITATIONS
The Joyness tries, within the site, to provide its customers with a detailed description of its products, but does not guarantee that the product description or any other content of the site www.thejoyness.com is complete or completely free of errors. The Joyness also does not assume responsibility for any type of loss such as: loss of data, lost profits, inability to use the data on this site, changes without prior notice to the data, prices or structure of the site.
The Customer is obliged to opt for the payment method chosen before placing the order, by checking the appropriate option, according to the steps of placing the order. The Seller will issue the Customer an invoice for the delivered products. in this regard, the Customer is obliged to provide the Seller with all the information necessary to issue the invoice, in accordance with the legislation in force. The invoice will be communicated to the Customer in printed material format upon delivery of the ordered products.
10. DELIVERY POLICY
The products are delivered by the Seller directly to the buyer's home / address specified by him. The order for products in stock will be shipped within 1-5 days from the order confirmation, via email. The order should reach you within a maximum of 9 working days from the date of order confirmation. This term may be modified by circumstances beyond our control, without exceeding a term of 13 working days, calculated from the date of receipt of your order. The order will be shipped in packaging that ensures transport security. The responsibility for any damage caused during transport of the product, parcel or package sent by us lies with the carrier in accordance with local legislation in force.
11. COMPLAINTS RESOLVING PROCEDURE
Any dissatisfaction related to accessing, using, registering on our website, placing an order, aspects related to the order placed and the like, will be communicated to us directly, either by phone, at PHONE NUMBER 0746100854 or by email at contact@thejoyness.com.
Your dissatisfaction will be recorded and you will receive a written response, at the email address mentioned when you brought your dissatisfaction to our attention, within a maximum of 3 working days. The client declares that he agrees not to make these dissatisfactions public (on social networks, media, discussions at private parties or in any other way) subject to bearing the damages caused for the image damage brought to The Joyness by these actions.
12. CHANGES TO THE TERMS AND CONDITIONS
The Joyness reserves the right to make changes at any time to the content of the website www.thejoyness.com, the policy, the terms and conditions of use, without prior notice to users in this regard, although we will be careful to notify customers of these changes. The user of the website www.thejoyness.com has the obligation to regularly check the terms and conditions of use. If he does not agree with the changes made to them by The Joyness, he will cease using the website. If the user continues to use the website, it is considered that he agrees with the changes made.
13. CONTRACTUAL LIABILITY
By creating and using the Account, the Client assumes responsibility for maintaining the confidentiality of the Account data (username and password) and for managing access to the Account, being responsible under the law for the activity carried out through his Account. By accessing the site, creating the Account, using the site, placing orders, etc., the Client expressly and unequivocally accepts the Terms and Conditions of the site in its latest version communicated within the site. After creating the Account, using the content is equivalent to accepting the changes made to the Terms and Conditions of the site and/or updated versions of the Terms and Conditions of the Site.
The Client is responsible for checking the final version of the Terms and Conditions whenever using the site. Acceptance of the Terms and Conditions of the site is confirmed by checking the corresponding checkbox on the site and/or by submitting the Order and/or by making an online payment. We do not assume responsibility for damages of any kind that the Customer or any other third party may suffer as a result of our performance of any of our obligations under the Order, nor for damages that may result from the use of the Goods after delivery, let alone for their loss. We cannot be held responsible for damages to your computer or viruses that may infect your computer or other equipment as a result of your accessing, using or browsing our site or downloading any content, information, materials, data, text, images, video or audio from our site.
14. RETURN POLICY
According to the legislation in force (Emergency Decree No. 34/2014), the right of withdrawal from the sales contract applies exclusively to individual customers. The legal withdrawal period is 14 calendar days from the date on which the Buyer takes physical possession of the purchased good. The Joyness voluntarily offers an extended period of 30 calendar days for the return of products.
14.1. Products purchased from The Joyness physical stores • Products purchased from The Joyness physical stores can only be returned to the same store from which they were purchased. • The customer must present the original tax receipt to validate the return. • The products must be in the same condition in which they were purchased, unused, sealed and in the original packaging. • The refund of the value of the products is made on the spot.
14.2. Products purchased online (www.thejoyness.com) • The Customer has the right to withdraw from the distance contract within 30 calendar days from the date of receipt of the product, without being obliged to justify the decision. • To exercise the right of withdrawal, the Customer must inform the Customer Relations Department at contact@thejoyness.com, or using the contact form available on the site.
Return conditions:
• The products must be returned in the same condition in which they were delivered, unused, sealed and in the original packaging, with all accessories, labels and related documents.
• If the products are returned in a condition that does not allow them to be resold as new, The Joyness reserves the right to apply a reduction in the value of the product to restore it to its original condition (if possible) or to cover the price difference resulting from its resale as a second-hand product. At the Customer's option, The Joyness may reship the product, at the Customer's expense.
• If the returned product was accompanied by a promotional gift, the Customer is obliged to return that gift product as well. Costs and refund:
• Return costs are borne by the Customer, according to art. 14 par. (2) of O.U.G. 34/2014, except in cases where the product is defective or was delivered incorrectly.
• The Joyness will refund all amounts received from the Customer, including the costs of the initial standard delivery, without undue delay, but no later than 14 calendar days from the date of receipt of the returned products or proof of their shipment.
• The refund of the value of the products is made depending on the payment method used:
• for orders paid by card online – the refund is made to the account from which the payment was made;
• for orders paid on delivery – the refund is made by bank transfer, to an account indicated by the Customer.
15. FORCE MAJEURE
Neither contracting party is liable for the failure to perform on time or/and for the improper performance - in whole or in part - of any obligation incumbent upon it under this contract, if the failure to perform or improper performance of the respective obligation was caused by force majeure, as defined by law, for reasons beyond the control of the parties. The party invoking force majeure is obliged to notify the other party, within 5 (five) days, of the occurrence of the event and to take all possible measures to limit its consequences.
16. APPLICABLE LAW
The contract will be governed and interpreted in accordance with Romanian law. Any disagreement between the Merchant and the Customer in relation to the relations arising from this Contract shall be resolved amicably, and in case of failure, shall be submitted to the competent courts of the CITY. Law no. 449/2003: on the sale of products and the guarantees associated with them Ordinance no. 21/1992: on consumer protection GEO 34 of 4 June 2014 on consumer rights in contracts concluded with professionals Regulation EC 1223/2009 of the European Parliament and of the Council on cosmetic products Regulation 2016/679/EU on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
17. FINAL PROVISIONS
This website is owned by Joyness SRL, which grants you the right to access and use the website subject to your acceptance of these Terms and Conditions. By accessing and using the website, you automatically and unequivocally agree to comply with the Terms and Conditions on the website. The Joyness has the right to modify the Terms and Conditions at any time, without prior notice, by posting the updated version on the website, and the Customer is obliged to read the Terms and Conditions whenever they access the website.
The Customer is obliged to strictly comply with the Terms and Conditions on the website and cannot claim or defend themselves with ignorance of the Terms and Conditions on the website, valid at the date of accessing, using and/or placing an order on the website. The Joyness periodically organizes various Promotions that are announced on the website. Promotions begin their validity when they are activated on the site and cease to be valid when they are deactivated on the site. Promotions cannot be combined with each other or with other discounts and are valid only while stocks last.
